Terms of Service
Effective: 2026-10-13 · v2.2
1. Introduction and acceptance
These Terms of Service ("Terms") govern your use of racem8 available at racem8.com and the related mobile apps (the "Service"). By creating an account or paying for a subscription you confirm that you have read, understood and agreed to these Terms.
If you do not agree, do not use the Service. The current version is always available on this page; we will notify you of material changes by email at least 30 days in advance.
2. Provider and contact
The Service is operated by, and the contracting party is:
- Company: Roads To Excellence s.r.o., Company ID 04430972, Nedvědovo náměstí 1164/14, Podolí, 14700 Prague 4, Czech Republic
- Statutory body: Tomáš Plojhar (managing director)
- Registration: Commercial Register kept by the Municipal Court in Prague, section C, file 247456
- Contact: support@racem8.com
3. Description of the Service
racem8 analyses your kart laps from telemetry and video — on the web, in the iPhone and Android apps and in the Mac and Windows app. You can share your sessions with a coach you connect with. Features and limits depend on your plan (Free, Pilot, Coach).
We reserve the right to evolve, modify or discontinue parts of the Service. We will notify you of material limitations of a paid tier at least 30 days in advance.
4. Account and registration
Most features require registration. You agree to:
- provide accurate and current information,
- not let third parties use your account (except team-space features, where team members log in with their own accounts),
- notify us immediately of suspected misuse,
- if you are under 16, registration requires consent of your legal representative,
- be responsible for all activity under your account.
You can sign up with e-mail and password, Google or Apple. With Apple's 'Hide My Email' we write to you only through Apple's relay address.
We may suspend or terminate the account on violation of these Terms, non-payment or reasonable suspicion of fraud — typically after notice and a cure period.
5. Your data and content
All data you upload to the Service (telemetry, photos, video, notes, setups) remains yours. By granting us a license you allow us solely to process it for the purpose of providing the Service — analyse, store and back it up for you.
We do not use your data to train general AI models, nor do we sell it. Aggregated, anonymised statistics (e.g. the average lap time at a track in one kart class) may appear in the product without identifying any specific user.
On account deletion you may export your data as a ZIP with CSV and JSON files within 30 days. After that we delete it.
6. Acceptable use
You agree not to break the law, abuse the Service for fraud, attempt to bypass security mechanisms, perform automated scraping, inject malware or spam, or infringe third-party rights (copyright in photos, trademarks, etc.).
Violations may lead to account suspension, content removal and, in serious cases, claims for damages.
7. Plans and payments
Pilot trial. After your first session you get 14 days of Pilot free — no card, nothing to cancel. When it ends you are on Free automatically and your sessions stay saved.
The Service has a free plan (Free) and paid plans (Pilot, Coach). Prices are shown on the pricing page and at checkout before you pay; the price you see is what you pay. Visitors from Czechia pay in Czech crowns, everyone else in euros; a plan keeps the currency it was bought in. Payments are processed by Revolut Bank UAB (card, Apple Pay, Google Pay, Revolut Pay).
- Pay now, cancel any time. A paid plan starts when the first payment goes through. Your card (or Revolut Pay) is saved with Revolut and charged automatically at the start of each period, monthly or yearly as you chose, until you cancel.
- Cancel any time in Plan & billing. The plan runs to the end of the period you paid for, then your account moves to Free. Your data stays.
- Changing plans. Moving up (Pilot → Coach, more riders on Coach) takes effect at once and we charge only the difference for the rest of the current period. Moving down takes effect at the end of the period; nothing is refunded for the current one. Switching between monthly and yearly takes effect at the next renewal.
- Coach seats. A Coach plan includes 3 riders. A coach can add a seat at any time; the added seat is charged for the rest of the current period, only after the coach confirms the amount. A rider who pays their own Pilot never takes a seat. A rider's action never charges anyone.
- A failed payment. If a renewal doesn't go through, the plan stays on and we try again 1, 3 and 7 days later and tell you by e-mail. If the last try fails, the plan ends and your account moves to Free (your data stays).
Your price stays: a renewal charges the price your plan was bought at. If we ever change the price of a plan you have, we tell you by e-mail at least 30 days before; you can cancel before it applies. Prices are final — we are not a VAT payer. Invoices for every payment are in Plan & billing.
8. 14-day money-back guarantee
If a paid plan isn't for you, write to support@racem8.com within 14 days of its first payment and we refund that payment in full, no questions asked, wherever you live.
For consumers in the EU this guarantee is in addition to the statutory right of withdrawal (§1829 of Act No. 89/2012 Coll., Directive 2011/83/EU).
We refund within 14 days, to the way you paid. Later payments (renewals) are not refunded, but you can cancel any time and no further payment is taken.
9. Coaches
You can connect with a coach in racem8; the coach then sees your sessions and their analysis until either of you disconnects. Coaches are independent of us; racem8 is not responsible for their advice. Any payment for a coach's own services is between you and the coach.
10. Limitation of liability
The Service is provided "as-is". We aim for high uptime and data accuracy, but make no warranties of error-free operation, uninterrupted availability or fitness of the analysis for the real situation on track. No analysis replaces the judgment of the driver or coach.
To the maximum extent permitted by law, our liability to you is capped at the amount you paid for the subscription in the last 12 months. This cap does not apply to intentional misconduct, gross negligence, or personal injury.
We are not liable for damages caused by incorrect kart setup, accidents, lost races, a team not recognising a result, or similar events related to kart racing.
11. Termination
You may terminate at any time by cancelling the subscription or deleting the account. The effects are described in section 7 (subscription) and section 5 (data).
We may terminate on material breach by you, non-payment after repeated reminders, or upon discontinuation of the Service with 30 days' notice.
12. Force majeure
We are not liable for outages caused by force majeure — internet outages, cloud provider failures (Hetzner, Google, Apple, Revolut), cyber attacks, pandemics, government action.
13. Out-of-court resolution of consumer disputes
Consumer disputes may also be resolved out of court. In the Czech Republic the competent body is the Czech Trade Inspection Authority (ČOI), which you may turn to as a consumer: adr.coi.cz. Our participation in out-of-court dispute resolution is voluntary.
14. Governing law and jurisdiction
These Terms and any disputes arising from them are governed by Czech law. The competent court is the court of the provider's registered seat (Prague); if you are an EU-resident consumer you may also bring proceedings in the court of your place of residence.
15. Changes to the Terms
We may amend these Terms unilaterally. We will notify you of material changes by email at least 30 days in advance. If you disagree, you may terminate before the changes take effect.
